《中华人民共和国社会保险法》于2011年7月1日起实施,第九十七条规定, 外国人在中国境内就业的,参照本法规定参加社会保险,第一次以国家立法的形式对外国人参保进行了明确规定,使得境内外籍员工参加社会保险具有广泛性、强制性。
The "Social Insurance Law of the People's Republic of China" was implemented on July 1st, 2011. Article 97 stipulates those foreigners who employed in China shall buy social insurance in accordance with this law. It is the first time to clearly define social insurance of foreigners in the form of national legislation and make it possible for foreign employees in China to participate in social insurance extensively and compulsory.

On September 6th, 2011,“Interim Measures for Participation in Social Insurance for Foreigners Employed in China”issued by Ministry of Human Resources and Social Security made subsequent definition.
第二条 在中国境内就业的外国人,是指依法获得《外国人就业证》、《外国专家证》、《外国常驻记者证》等就业证件和外国人居留证件,以及持有《外国人永久居留证》,在中国境内合法就业的非中国国籍的人员。
Article 2 Foreigners employed in China is a non-Chinese nationality legally employed in China with foreigner permanent residence or foreigner residence permit as well as employment documents such as foreigner work permit, foreign expert certificate or resident foreign press card.
第三条 在中国境内依法注册或者登记的企业、事业单位、社会团体、民办非企业单位、基金会、律师事务所、会计师事务所等组织(以下称用人单位)依法招用的外国人,应当依法参加职工基本养老保险、职工基本医疗保险、工伤保险、失业保险和生育保险,由用人单位和本人按照规定缴纳社会保险费。
Article 3 Foreigners who are legally registered in Chinese association such as enterprises, institutions, social organizations, private non-enterprise units, foundations, law firms, accounting firms (hereinafter referred to as employers) shall participate in basic endowment insurance, basic medical insurance, work injury insurance, unemployment insurance and maternity insurance for employees according to the law, and employers and employees shall pay for social insurance premiums according to the regulations.
与境外雇主订立雇用合同后,被派遣到在中国境内注册或者登记的分支机构、代表机构(以下称境内工作单位)工作的外国人,应当依法参加职工基本养老保险、职工基本医疗保险、工伤保险、失业保险和生育保险,由境内工作单位和本人按照规定缴纳社会保险费。
After signing employment contract with overseas employer, foreigners who dispatched to work in branches or representative offices (hereinafter referred to as domestic work units) registered in China shall participate in basic endowment insurance, basic medical insurance, work injury insurance, unemployment insurance and maternity insurance for employees,and employers and employees shall pay for social insurance premiums according to the regulations.
我国人力资源和社会保障部早已与多个国家进行过相应协定,而这些协定就成为外国人在中国参与社会保险的特殊情况。之所以称之为特殊情况,是因为除了特殊情况之外,外国人在中国参加社会保险应当等同于中国公民,均应参与“养老、医疗、工伤、生育、失业”五个险种。
China’s Ministry of Human Resources and Social Security has already had corresponding agreements with a number of countries, and these agreements have become a special case for foreigners to participate in social insurance in China. 对于首次参保的外国人,应该由用人单位携带相关材料,到参保所在地的社保经办机构或社保网上系统为其办理参保手续。
For those foreigners who insure for the first time, employers should carry relevant materials to local social security bureau or social security online system to apply social insurance.

外籍人员参保办理流程:

1、通过网上申报系统办理,登录社保局网站企业网上申报;

2、打印 《企业员工参加社会保险个人信息登记/停交/调动/险种变更/恢复参保/工资变动申请》、附上申请资料到征收前台办理。

In some cities, social security for employees from Hong Kong, Macao, Taiwan and foreign nationality has not yet achieved online self-service operation. Company responsible persons are required to bring the following materials to relevant window of social security bureau (sub-bureau or management station) to handle the insurance:
1、《企业员工首次参加社会保险个人信息登记表》(盖公章)
“Personal information registration form for employees in enterprises participate in the social insurance for the first time” (with official seal)
2、参保人有效身份证件(验原件收复印件,复印件需加盖单位公章);
Valid ID card (Check the original and accept the copy, and the copy must be stamped with the official seal of employers);
外籍人如何享受社保待遇
How do foreigners enjoy benefits of social security?
中国参加社会保险的外国人,符合条件的,依法享受社会保险待遇。以养老保险为例,凡累计缴费满15年以上,达到我国法定退休年龄(男年满60岁,女年满55岁)的外籍员工,既可以在中国养老,按月领取基本养老金;也可以在境外按月领取养老金,但应当至少每年向负责支付其养老金的社会保险经办机构提供一次由中国驻外使、领馆出具的生存证明,或者由居住国有关机构公证、认证并经中国驻外使、领馆认证的生存证明。如果外国劳动者在达到规定的领取养老金年龄前离境的,其社会保险个人账户予以保留,再次来中国就业的,缴费年限累计计算;经本人书面申请终止社会保险关系的,也可以将其社会保险个人账户储存额一次性支付给本人。
Foreigners who participate in social insurance in China are eligible to receive social insurance benefits according to law. Taking pension insurance as an example, foreign employees who have accumulated their contributions for more than 15 years and have reached the statutory retirement age of China (60 years old for males and 55 years old for females) can pension in China and receive basic pensions on a monthly basis. They can also receive a monthly pension from abroad with providing at least one annual survival certificate issued by a Chinese foreign embassy or consulate to the social insurance agency responsible for paying its pension, or notarized and certified by the relevant institution and proof of survival certified by Chinese embassies and consulates abroad. If a foreign worker leaves China before reaching the prescribed pension age, his or her social insurance personal account will be retained. If he or she comes to China again, the payment period will be calculated cumulatively. If he or she applies in writing to terminate the social insurance relationship, the social insurance personal account deposit amount can be paid in one lump sum.
